CIDH PRESENTA INFORME SOBRE LA
SITUACIÓN DE LAS PERSONAS AFRODESCENDIENTES EN LAS AMÉRICAS
Washington, D.C., 18 de enero de 2012 – La
Comisión Interamericana de Derechos Humanos (CIDH) publicó hoy el informe La situación de las personas afrodescendientes en las
Américas. El informe presenta una evaluación inicial respecto de la
situación de las personas afrodescendientes en las Américas y formula
recomendaciones a los Estados para avanzar en la protección de sus derechos
humanos. El Informe se realizó en el marco de las actividades realizadas por la
CIDH por el Año Internacional de los Afrodescendientes. 
El principio de no-discriminación es un
pilar de la democracia y es una de las bases fundamentales del sistema
interamericano de derechos humanos. Sin embargo, las personas afrodescendientes
en las Américas continúan siendo víctimas de la exclusión, el racismo y la
discriminación racial y han sido invisibilizados, aún cuando constituyen la
mayoría poblacional de algunos Estados de la región. A pesar de que los
afrodescendientes representan aproximadamente el 30% de la población de las
Américas, la variable “afrodescendencia� no se ha incorporado en los censos u
otros mecanismos de relevamiento de la población sino hasta recientemente. 
Como consecuencia de la discriminación
estructural existente las personas afrodescendientes habitan, en general, en
las zonas más pobres y con menor infraestructura y se encuentran más expuestas
al crimen y la violencia. Asimismo, las personas afrodescendientes enfrentan
serios obstáculos para acceder a los servicios de salud y educación, obtener
una vivienda y acceder a empleos, especialmente en los niveles gerenciales. En
este sentido, la Comisión concluye que las personas afrodescendientes enfrentan
importantes obstáculos en relación con el ejercicio y la garantía de sus
derechos civiles y políticos, económicos, sociales y culturales.
Adicionalmente, la subrepresentación y escasa participación de la población
afrodescendiente en la esfera política demuestran impedimentos adicionales para
acceder a las estructuras del poder político y así tomar parte activamente en
el diseño de políticas públicas orientadas a mejorar su situación de
discriminación estructural. 
El informe también analiza los obstáculos
que enfrentan los afrodescendientes para poder acceder a mecanismos de justicia
que le den respuesta a la discriminación existente. La Comisión reconoce como
un paso positivo que en algunos países se hayan adoptado leyes orientadas a
combatir la discriminación racial. Sin perjuicio de lo anterior, la Comisión
observa que los obstáculos en el acceso a mecanismos de denuncia y reparación, ya
sean administrativos o judiciales, así como la falta de sensibilidad de los
operadores de justicia, contribuyen a perpetuar los patrones de segregación y
exclusión. 
La Comisión considera imprescindible que los
Estados de la región adopten medidas positivas para erradicar la discriminación
racial en el Hemisferio y garantizar efectivamente los derechos de las personas
afrodescendientes. Para ello, es necesario contar con información adecuada y
desagregada. Asimismo, es preciso destinar los recursos humanos y financieros
necesarios que permitan desactivar los prejuicios y estereotipos raciales
existentes y mejorar las condiciones de vida de las personas afrodescendientes,
en especial la situación de múltiple discriminación que padecen las mujeres
afrodescendientes. En particular, los instrumentos de derechos humanos, tanto
en el sistema universal como en el sistema interamericano han reconocido la
necesidad de recurrir a medidas de acción afirmativa para remediar o compensar
situaciones estructurales de discriminación histórica contra ciertos grupos y
evitar que dicha discriminación se perpetúe. Se trata de una herramienta
excepcional y temporal, necesaria para garantizar la igualdad sustantiva y el
disfrute de los derechos fundamentales de las personas y grupos sociales en
situaciones de desventaja histórica o víctimas de prejuicios persistentes. 
La Comisión reitera su compromiso de
colaborar con los Estados de la región en la búsqueda de soluciones a los
problemas identificados. Varias medidas adoptadas para hacer frente a esta
situación ponen de manifiesto la comprensión y el reconocimiento de la gravedad
de los problemas existentes y el compromiso de los integrantes de los sectores
estatal y no estatal de abordar efectivamente los obstáculos que enfrenta la
población afrodescendiente. En particular, la Comisión destaca que el
fortalecimiento de los mecanismos de justicia internos y la adopción de medidas
para superar los obstáculos en el acceso a las garantías judiciales,
constituyen la primera línea de defensa en la protección de los derechos
humanos de la población afrodescendiente. 
Este informe se realizó gracias al apoyo
financiero de la Unión Europea. 
La CIDH es un órgano principal y autónomo de
la Organización de los Estados Americanos (OEA), cuyo mandato surge de la Carta
de la OEA y de la Convención Americana sobre Derechos Humanos. La Comisión
Interamericana tiene el mandato de promover la observancia de los derechos
humanos en la región y actúa como órgano consultivo de la OEA en la materia. La
CIDH está integrada por siete miembros independientes que son elegidos por la
Asamblea General de la OEA a título personal, y no representan sus países de
origen o residencia.

IACHR Presents Report on the Situation of
People of African Descent in the Americas
Washington, D.C., January 18, 2012 - The Inter-American Commission on Human
Rights (IACHR) published today the Report The
Situation of Persons of African Descent in the Americas. The report
presents an initial evaluation with respect to the situation of afro-descendant
persons in the Americas and makes recommendations to the States to advance in the protection of their
human rights. The report was elaborated in the context of the activities of the
IACHR in the International Year of Afro-descendants. 
The principle of
nondiscrimination is one of the pillars of the democratic system and is one of
the fundamental bases of the inter-American system of human rights. However,
afro-descendant persons in the Americas continue to be victims of exclusion, racism and racial discrimination and have
been invisibilized, even when they are the majority of the population in some
of the countries in the region. Despite afro-descendants represent
approximately 30% of the population of the Americans, the variable “afro-descendance�
had not been included in the census until recently. 
As a consequence of
the structural discrimination, afro-descendant persons live, in general, in the
poorest areas and with the most precarious infrastructure, and they are more
exposed to crime and violence. Furthermore, Afro-descendants encounter serious
obstacles regarding access to health and education services, as well as in
obtaining housing and employment, especially at the managerial and upper
levels. Accordingly, the Commission concludes that persons of African descent
face major obstacles for the exercise and guarantee of their civil and
political, economic, social, and cultural rights. Similarly, under
representation and the scant participation of the Afro-descendant population in
politics demonstrate the existence of further impediments to access to
political power structures and to an active role in the design of public
policies designed to improve their situation of structural discrimination. 
The report also
analyzes the obstacles that the Afro-descendant population faces in the Americas when
trying to access domestic judicial remedies in response to the existent
discrimination. The Commission acknowledges on a positive note that some
countries have recently approved legislation designed to combat racial discrimination.
Notwithstanding the foregoing, the Commission observes that the obstacles in
the access to complaint and reparation mechanisms, be they administrative or
judicial, as well as the lack of sensitivity of justice operators, is a factor
that help perpetuate patterns of segregation and exclusion. 
The Commission
considers it essential for States in the region to adopt positive measures to
eradicate racial discrimination in the Hemisphere and provide effective
guarantees of the rights of Afro-descendants. To that end, there has to be
proper and disaggregated information. Moreover, it is necessary to have
sufficient and specific human and financial resources devoted not only to
neutralizing prejudice and racial stereotypes but also to improving the living
conditions of persons of African descent with respect to health, housing,
education, and work, paying particular attention to the multiple discrimination
to which Afro-descendant women are exposed. Human rights instruments in both
the universal and the inter-American systems have specifically recognized the
need to resort to affirmative action measures to remedy or offset structurally
historical discrimination against certain groups and to prevent such
discrimination from persisting. Affirmative action measures are an exceptional
and temporary tool, needed to guarantee the substantive equality and enjoyment
of fundamental rights of historically disadvantaged persons and social groups
or victims of ongoing prejudice. 
The Commission
reiterates its commitment to cooperate with the States in the region in the
search for solutions to the identified problems. Several measures already
adopted to solve the situation show the understanding and recognition of the
seriousness of the ongoing problems and the commitment of the members of the
Government and non-governmental sectors to effectively solve the obstacles
faced by the Afro-descendant population. In particular, the Commission
highlights that the strengthening of the mechanisms of justice at the national
level and the adoption of measures to overcome the obstacles in the access to
judicial guarantees, constitute the first line of defense in the protection of
human rights of the afro-descendant population.

autonomous body of the Organization of American States (OAS), the IACHR derives
its mandate from the OAS Charter and the American Convention on Human Rights.
The Inter-American Commission has a mandate to promote respect for human rights
in the region and acts as a consultative body to the OAS in this matter. The
Commission is composed of seven independent members who are elected in an
individual capacity by the OAS General Assembly and who do not represent their
countries of origin or residence.
